Building the policy around the test
Write the threshold into the document. A policy saying "nicotine testing" without a cutoff is unenforceable in practice, because 16, 200 and 300 ng/mL give different answers on the same person. Name the number and the specimen.
Decide what a positive triggers before the first test. An incentive differential, a cessation referral and discipline carry different legal exposure.

Can we simply refuse to hire smokers? In much of the country, no.
